The ELD Mandate Explained: 2026 Rules, Exemptions, and Compliance

The ELD mandate is settled law since 2019, but the details still trip up new fleets and owner-operators. Here's the current state.

    The real problem

An uncertified ELD or one that malfunctions for >8 days while the driver hasn't reverted to paper is an instant violation.

    By the numbers

    ELD violation fine
    $1,275+
    ELD malfunction grace
    8 days
    Pre-2000 engine exemption
    Yes
    Short-haul 150-mile exemption
    Yes (with conditions)

    Who's required

Any property carrier subject to HOS rules, with limited exemptions: pre-2000 engine, short-haul drivers operating within 150 air-mi using time cards, drivers with <8 days HOS logs in 30-day period, driveaway-towaway.

    Picking a certified device

Only devices on FMCSA's self-certified list count. Always check the registration is current — devices get removed when manufacturers cease support.

    Malfunction handling

Driver must note malfunction, revert to paper logs, reconstruct prior 7 days, notify carrier in 24 hr, and the carrier must repair/replace within 8 days.

    Frequently asked questions

    Are personal conveyance hours regulated?

Personal conveyance is allowed when the vehicle is unloaded (or laden under specific conditions) and the driver is off-duty. Must be marked PC in the ELD.
